【松文館事件】結果のご報告【上告棄却】
松文館事件の上告審について、２００７年６月１４日付で上告棄却の決定がありました。
具体的な理由の説明なく、ただ、従前の最高裁判例に追随するだけの残念なものでした。
この決定により、控訴審の罰金１５０万円の判決が確定することになります。
関与した裁判官は、
最高裁判所第一小法廷
才口 千晴
横尾 和子
甲斐中辰夫
泉 徳治
の４名です。全員一致の決定でした。
上告から２年が過ぎ、これはひょっとすると、と期待していただけに非常に残念な内容でした。
ライフワークの筈を３０そこそこで達成してはいかん、ということなのでしょうか？
表現の自由は、歴史的にも権力との戦いの中で市民が手にした基本的人権です。今回の戦いの結果は敗北でした。これは受け止めなくてはならないと思います。しかしながら、敗北を受け止めることと戦いを終えることは違います。松文館と弁護団の戦いの記録は、傍聴人の方により公開されています。これから戦う方々は、是非とも、記録を読み、批判し、また、参考にして頂きたいと思います。

表現の自由と言えば、忘れてはいけないのが、名誉毀損の問題です。

初めてコメントします。僕も最近この裁判のことを知って調べています。
僕は法律は詳しくありませんが、本当の民主主義なら表現の自由を重視した結果になっていたと思います。漫画家も仕事で描いているのにあまりにも酷い判決です、だいたい未成年の子供にちゃんと目を向けないで見せている親が悪いのです（これでも僕まだ10代です）。
下手な文章でしたが、これからもお仕事頑張って下さい。

事実を伝えるということの意味を
しっかりと身についている山口氏
目線がずれてないということになりますね
ずれている方のBlogやWebsiteでは
ご自分達の不都合な状況は絶対に
載せないですから
あの某歌手氏のWebsiteでは
不都合な状況は隠してご自分達の
都合の良い情報だけを、、
例えどんな結果でも
真実からお目めを外さない姿勢は
弁護士というのがわかりますの
ご依頼人の出版社も、裁判を通して
お考えになれる何かを得たはず

松文館事件の精神で行くとアストリッド・リンドグレーン原作のDu är inte klok Madicken(邦題：川のほとりのおもしろ荘)(原文はスウェーデン語)
も持っているだけでロリコンとして処罰されてしまうのですね。このビデオの始めのほうに主人公の女の子たちの一糸まとわぬ裸が出てきますので.....

人権侵害救済法案とつながるものを感じ裁判について調べています。
「猥褻」や「人権侵害」という曖昧なまま司法側のさじ加減で有罪・無罪が決定してしまうことに寒気を感じます。
この問題を風化させないよう広めていきたいです。
